Recently, the State Administration of Market Supervision and Administration and the National Standardization Administration Committee have approved and issued a number of national standards for plant protection and agricultural products. Among them, the release of GB/T 37500-2019 "Determination of Plant Growth Regulators in Fertilizers by High Performance Liquid Chromatography" will give the market a check on whether plant growth regulation is added to fertilizer products. Agents are guided by methods, which makes plant growth regulators in fertilizers nowhere to hide.
Plant growth regulators are substances with similar physiological and biological effects to plant hormones. Amino fresh ester (DA-6), chlorfepiride, sodium dinitrophenol, gibberellin, ethephon, Brassinolide and Paclobutrazole have been found to have the functions of regulating plant growth and development.
Plant growth regulators belong to the category of pesticides. They should be used according to the dosage, time and method indicated on the registration and approval label. The use of plant growth regulators is generally not harmful to human health. If the use is not standardized, the crop may grow too fast, or the growth may be inhibited, or even die. It will affect the quality of agricultural products and harm human health.
In recent years, the Ministry of Agriculture and Rural Areas has mobilized and deployed a nationwide campaign to combat agricultural counterfeiting, focusing on spot checks of pesticides, fertilizers and seeds. The action also focuses on investigating and dealing with illegal additions of pesticides in fertilizers, such as inadequate effective ingredients, unregistered, multi-use of one certificate, forged registration certificates, nominal pesticide functions of fertilizer products and foliar fertilizers, especially plant growth regulators.
Explicit provisions of laws and regulations
According to Article 44 of Chapter VI of the New Pesticide Regulations
If one of the following circumstances occurs, it shall be deemed to be a false pesticide:
(1) passing off non-Pesticides as pesticides;
(2) Using this pesticide as another pesticide;
(3) The types of active ingredients contained in pesticides do not conform to the labels and instructions of pesticides.
Prohibited pesticides, pesticides manufactured or imported without obtaining the registration certificate of pesticides according to law, and pesticides without labels shall be treated according to false pesticides.
As long as pesticides are added to fertilizers, the product belongs to pesticides and should be registered, produced, managed, used and monitored according to pesticides. If the registration certificate for pesticides is not processed, the pesticides produced without the registration certificate for pesticides according to law, or the kinds of active ingredients contained in the pesticides do not conform to the labels of the pesticides and the effective ingredients labeled in the instructions, and are determined to be false pesticides.
Strict penalties for violations
Article 52 of Chapter VII of the Regulations on Pesticide Administration stipulates that: "Where pesticides are produced without a pesticide production license, the competent agricultural department of the local people's government at or above the county level shall order them to stop production, confiscate the illegal income, products produced illegally and the tools, equipment and raw materials used for illegal production, etc. If the value of illegally produced products is less than 10,000 yuan, a fine of more than 50,000 yuan and less than 100,000 yuan shall be imposed, and a fine of more than 10,000 yuan and less than 20 times of the value shall be imposed. The license issuing organ shall revoke the pesticide production license and the corresponding pesticide registration certificate; if the case constitutes a crime, criminal responsibility shall be investigated in accordance with the law.
Article 55 of Chapter VII of the Regulations on Pesticide Administration stipulates that: "Where counterfeit pesticides are operated, the competent agricultural department of the local people's government at or above the county level shall order them to stop operation, confiscate the illegal income, the illegal pesticides and the tools and equipment used for illegal operation, and the value of the illegally operated pesticides shall be less than 10,000 yuan, and shall be punished with 50,000 A fine of not less than 5,000 yuan but not more than 50,000 yuan and a fine of not less than 10,000 yuan with a value of more than 10,000 yuan shall be imposed. If a crime is constituted, criminal responsibility shall be investigated in accordance with the law."
